Rusty Hardin & Associates secured an appellate victory on behalf of Houston nonprofits YMCA of Greater Houston, Legacy Community Health Services, St. Luke’s United Methodist Church, and KIPP Houston Public Schools.
On Feb. 13, the 14th Court of Appeals affirmed a lower court’s decision to dismiss a 2017 lawsuit filed against these nonprofits by the Grant Me The Wisdom Foundation. The lawsuit stemmed from the creation of a separate nonprofit organization, Connect@6800 Bellaire Inc., a community center to connect underserved communities to the services of nonprofits.
In 2015, the nonprofits moved forward with a community center without Grant Me The Wisdom’s involvement. The Foundation then filed suit, asserting contract and tort claims against the nonprofit entities. The trial court dismissed all of Wisdom’s claims, and the 14th Court of Appeals has recently affirmed the trial court’s judgment.
